Terms of service

These terms apply to video production by Sawa Studios, run by Anna Wojtasinska in Sydney (ABN 81 763 012 041). Every booking also has a written agreement setting out the scope, dates and price for that project. If the two differ, the agreement for your project applies.

Quotes

Every quote sets out what is included and what it costs. It is valid for 14 days from the date it is sent. Sawa Studios is not registered for GST, so no GST is charged.

Booking and payment

• A deposit of 20% of the fee confirms your date. It is due within 7 days of signing; if it is not paid by then, the booking lapses.
• The balance is invoiced once you approve the final edit, and is due within 7 days. If no changes are requested within 30 days of delivery, the edit counts as approved.
• The final files are sent once the balance is paid.

Moving or cancelling a booking

• You can move your date once at no cost with 14 days’ notice. The deposit carries over to the new date.
• If you cancel more than 14 days before the shoot, the deposit is kept. Within 14 days of the shoot, 50% of the fee is due, and the deposit counts towards it.

Weather

If the forecast rules out an outdoor shoot, we decide together 24 to 48 hours before and move it to the next date that suits us both, at no cost.

If I can’t film

If illness or an emergency stops me filming on the day, you choose between a new date and a full refund of everything you have paid.

On the day

• Filming runs for the hours booked. Time beyond them is charged at $250 an hour, and only with your agreement on the day.
• Travel within Greater Sydney is included. Travel anywhere else is quoted with the project.
• You are responsible for access to the location, any permits it needs, and letting the people being filmed know that filming is taking place.

Revisions

Every project includes two rounds of revisions on the edit. Further rounds are $150 each. If you are still unhappy after both rounds, you can end the project at that point for 60% of the fee, and the videos are not delivered.

Delivery

The first edit is delivered within two, three or four weeks of the shoot, depending on the size of the project, in the formats agreed at the brief. Final files are available to download for 30 days; re-sending them after that is $50.

Ownership and use

• Once the project is paid in full, you own the finished videos and stills outright, with no limit on how long or where you use them.
• Music is licensed for the uses agreed at the brief.
• Raw footage is not included, and can be bought as an addition.
• The finished videos may appear in my portfolio and on social media, unless you ask in writing that they don’t.

Liability

Sawa Studios’ liability for any project is limited to the fee paid for it, except where Australian Consumer Law says otherwise.

Governing law

These terms are governed by the laws of New South Wales, Australia.
